This website is operated by Maddie Liz Tans DBA The Sunless Bar ("The Sunless Bar," "we," "us," or "our"). We offer this website, including all information, tools, products, and services available from it, to you, the user, conditioned on your acceptance of these Terms of Service ("Terms"). By visiting our site, purchasing a product, requesting or booking an appointment, joining a waitlist, or starting a subscription, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the site.

Our store is hosted on Shopify, which provides the online e-commerce platform that allows us to sell our products and services to you.

1. Eligibility and Use of the Site

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence, or that you have given us consent to allow a minor dependent in your care to use this site. You may not use our products or site for any illegal or unauthorized purpose, interfere with the security or operation of the site, or transmit any harmful code.

2. Products and Purchases

We make every effort to display our products, colors, and descriptions as accurately as possible, but we cannot guarantee that your device's display of any color will be accurate. We reserve the right to limit quantities, refuse or cancel any order, and discontinue any product at any time. Prices are subject to change without notice.

All sales are final. We do not offer refunds or exchanges. If your order arrives damaged, please contact us at support@thesunlessbartanning.com within 72 hours of delivery so we can assist you. Please allow 1 to 3 business days for order fulfillment and shipping. Made-to-order items may have extended processing times.

Subscriptions. You can cancel a product subscription at any time. Cancelling stops future orders and charges. Orders that have already been charged are final.

3. Spray Tan Services and Appointments

  • Requests and confirmation. Submitting an appointment request does not guarantee a booking. Your appointment is confirmed only once we confirm it with you directly.
  • Deposits. A deposit is required to reserve every booking. Deposit, cancellation, and rescheduling terms will be shared with you when your appointment is confirmed.
  • Concierge services. Concierge pricing includes travel within the service area stated at booking. You are responsible for providing a safe, suitable space for your appointment.
  • Clients under 18. Clients under 18 must wear underwear during their spray tan, and a parent or legal guardian must be present for the entire appointment.
  • Health and sensitivities. You are responsible for telling your artist about any allergies, skin sensitivities, skin conditions, pregnancy, or medications before your service. If you have concerns about how a sunless product may affect you, please consult your physician before booking.
  • Results. Spray tan results vary based on your skin, prep, aftercare, and other factors outside our control. We do not guarantee a specific color, development, or length of wear.
  • No sun protection. A spray tan does not protect your skin from the sun and is not a base tan. Always wear SPF.

4. The Sunless Bar Exam™

The Sunless Bar Exam™ is a private professional certification. It is not a government license and is not issued by an accredited institution. It is not intended to satisfy any state licensing, cosmetology, esthetics, or vocational-school requirement. You are responsible for determining and following the licensing, facility, business, and tax requirements in your own state and city. The program does not guarantee employment, income, or business results. Enrollment may be subject to additional terms presented at the time of purchase.

Course access and grading window. Your access to the course lessons never expires. To be graded, your filmed Practical must be submitted within 6 months of your enrollment date. After 6 months, grading of your Practical requires the purchase of a paid grading extension. This grading window applies to enrollments made on or after October 13, 2026.

Payment plans. If you enroll on a payment plan, you are responsible for all scheduled payments. Your certificate is issued once your plan is paid in full.

Refunds. Because The Sunless Bar Exam is a digital program with instant access, enrollment is final and non-refundable.

5. Reviews, Comments, and Submissions

If you submit reviews, photos, comments, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business. You agree that your submissions will not be unlawful, misleading, or infringe on the rights of any third party. We may, but have no obligation to, monitor, edit, or remove content.

6. Third-Party Links and Affiliate Disclosure

Our site may include links to third-party websites, including affiliate links. We may earn a commission on purchases made through some of these links, at no additional cost to you. We are not responsible for the content, products, or practices of third-party websites, and any purchase you make from a third party is between you and that third party.

7. Intellectual Property

All content on this site, including text, images, logos, branding, and course materials, is owned by or licensed to The Sunless Bar and is protected by intellectual property laws. You may not copy, reproduce, or use our content without our written permission.

8. Disclaimer of Warranties and Limitation of Liability

The site, products, and services are provided "as is" and "as available" without warranties of any kind, except as required by law. To the fullest extent permitted by law, The Sunless Bar and its owners, artists, and affiliates will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site, products, or services. Our total liability for any claim will not exceed the amount you paid us for the product or service giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless The Sunless Bar and its owners, artists, and affiliates from any claim or demand arising from your breach of these Terms or your violation of any law or the rights of a third party.

10. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions.

11. Changes to These Terms

We may update these Terms at any time by posting the updated version on this page. Your continued use of the site after changes are posted means you accept the updated Terms.
